Abstract

This research analyzes the concept of legal liability in blockchain-based document verification under Indonesian Information Technology Law, employing a Law and Economics theoretical framework. Blockchain, as a decentralized technology, offers high transparency and security in document verification but also introduces legal challenges concerning liability in cases of errors. This study examines the role of Electronic System Operators (ESOs) and validators in blockchain mechanisms and the complexities of assigning legal responsibility for technical errors or data verification failures. Using a qualitative normative approach and Guido Calabresi’s liability theory, particularly the cost-minimization principle, this research evaluates the fairness of liability allocation. The findings reveal that Indonesian law has not fully adapted to the dynamics of blockchain technology, especially regarding assigning responsibility to the party best positioned to prevent harm. Through the lens of a responsive regulatory framework, this study recommends adaptive legal reforms that not only safeguard user interests but also encourage technological innovation.
