Abstract
The Decision of the Indonesian Supreme Court Number 845 K/Pdt/2024 addresses
crucial aspects of inheritance law in Indonesia, particularly the division of inheritance
assets. In its considerations, the Supreme Court referred to civil inheritance law as regulated
by the Indonesian Civil Code (KUHPerdata) and, when applicable, Islamic inheritance law.
The division of inheritance involves not only legal aspects but also ethical, social, and
religious values. The Supreme Court ensures that the distribution of inheritance is carried
out fairly and in accordance with the rights of each heir, while also providing legal certainty
for the parties involved. As part of its effort to achieve justice, the Supreme Court assesses
the evidence presented by the parties claiming inheritance rights. In this case, the principle of
legal certainty is fulfilled by applying clear and consistent legal provisions. The principle of
utility is also maintained by considering the social impact of the decision, although there may
be dissatisfaction from parties who feel their share is inadequate. Thus, this ruling not only
reflects adherence to legal regulations but also efforts to achieve justice, legal certainty, and
utility in the resolution of inheritance disputes.
